Thanks to the relentless hard work of Attorney Scott Gross, a former nurse is freed from jail after serving four months of her nine-month sentence. Attorney Gross’ client, Kimberly Lappe, was ordered to be released from Suffolk County Jail on Friday, where she was serving time after being charged — along with several other staff members — in the death of a Medford nursing home resident.

Advocating For What’s Right

Kimberly was convicted of five charges and sentenced in October. Attorney Gross has since then actively petitioned to State Supreme Court Justice John M. Leventhal, telling him that the judge who oversaw Kimberly’s trial made an error in sentencing her to five years’ probation and nine months in jail. Attorney Gross argued that the maximum punishment was five years’ probation and six months in jail.

During trial, Attorney Gross was able to point out gaping holes and inconsistencies in the prosecution. His aggressive approach and cross confrontation resulted in the prosecution’s key witness admitting to lying to jurors.

Attorney Scott Gross said in light of her early release, Kimberly is looking forward to giving her family a “big hug.” The appellate court justice has suspended her sentence temporarily and has given Kimberly 120 days to file an appeal.
